- train that crashed on Aug. 28, killing five people and injuring
- 200; on five counts of second-degree murder; in New York City.
- Prosecutors upgraded the charges from manslaughter as a result
- of new evidence that Ray fell asleep at the controls and failed
- to apply the brakes because he had been drinking. If convicted
- of murder, Ray faces a minimum sentence of 15 years to life.
