  15. train that crashed on Aug. 28, killing five people and injuring
  16. 200; on five counts of second-degree murder; in New York City.
  17. Prosecutors upgraded the charges from manslaughter as a result
  18. of new evidence that Ray fell asleep at the controls and failed
  19. to apply the brakes because he had been drinking. If convicted
  20. of murder, Ray faces a minimum sentence of 15 years to life.
